Overview

This document constitutes as a “Privacy Notice” as required under the Digital Personal Data Protection Act, 2023 and the rules promulgated thereunder.

Envogue Styles Global LLP, (hereinafter referred to as “Company”) is the licensed owner of the Platform (hereinafter referred to as “Urbanic”, “we” or “us”) and operates Urbanic Website (in.urbanic.com) and the mobile application “Urbanic” together referred to as “Platform” and is the Data Fiduciary with respect to the processing of your Personal Data. We respect our customers’ (hereinafter referred to as “Customer”, “You”, User”, “Data Principal”) concerns about privacy and recognize the importance of being transparent regarding the Personal Data we collect about you.

This Privacy Notice describes the types of Personal Data we collect about you, how we may use that data, with whom we may share it and the rights you have regarding our use of that data. This Notice also describes the measures we take to protect the security of the Personal Data, how long we retain it and how you can contact us to exercise your rights.

This Privacy Notice is applicable to customers of the Urbanic group including current, former, potential customers or users of a product or service offered by us, visitors to our Platform or members of our loyalty/membership programs.

1. What Personal Data we collect and why do we collect

Urbanic collects the following data about you as listed below. This list is not exhaustive, and in specific instances, we may need to collect additional data for the purposes set out in this Privacy Notice.

Category: User Data

Description and Purpose: Personal Data that we need to create your account and that enables our services and showcases our products. This includes your:

1. Phone Number

2. Email Address

3. Name

4. Birthday (for Age Verification)

5. Gender

6. Category Preferences

7. IP Address

8. Data about your devices such as device ID, network connection type, provider, browser type, operating system, Urbanic application version etc

9. Third-party user IDs (e.g. Google user ID, Facebook user ID, and Apple user ID)

10. Body & Size for fitment of purchased goods

 

Category: Behavior Data

Description and Purpose: For personalized ads and recommendations of products

1. Online identifiers such as cookie data, web beacons and other similar data collected through tracking technologies.

2. Data such as visited pages and browsed products for personalised ads and personal recommendations.

3. Kindly note that Personalized Ads are shown to you on other platforms (like social media) based on your interactions with us.

Personalized Recommendations happen on our own app or website to suggest content or products you may like.

You can choose whether to allow either, and update your preferences anytime through Privacy Settings menu in the app.

 

Category: Payment and Purchase Data

Description and Purpose: If you make purchases from Urbanic, we need to process your payment data. It will include data such as:

1. Name

2. Payment Method (Debit/ Credit Card, UPI, Cash on Delivery)

3. For Debit/Credit Card: Card Type, Expiration Date & last 4 digits of your card number.

4. ZIP/ Postal Code

5. Details of Purchase and Purchase History

 

Category: Location Date

Description and Purpose: To verify if delivery service is available in the area and to deliver ordered goods.

Description and Purpose: To send order updates/ confirmations, customer service and support, handle returns or exchange of products

Description and Purpose: We collect certain data from you such as feedback or review for our products in the comment/review section. This helps us in improving our products/services.

2. How and when we collect your Personal Data

We collect your Personal Data when you:

• Visit our website or use the application, including activities such as registering on our website or in the application, leaving reviews or comments, uploading photos etc.. When you visit or use our website or mobile application, we also automatically collect certain data through cookies and similar technologies.

• Through joining the Urbanic Membership Program (Loyalty Program) which is open to the registered users.

• Contact us through the “Contact Us” option on the website/application, to reach out to the Customer Service Department via email, online Chat Support, call, or request data through any other means.

• Communicate with us through social networking websites, third-party applications, or similar technologies.

We may also collect data about you from third-party sources, such as from your use of other websites/applications, and from social media platforms (e.g., Instagram, Facebook, and any other social media platform) In such cases, we ensure that the proper legal basis and/or prior consent is in place before collecting such data. It is important to note that you have control over your access and consent for each of these platforms and companies. You can revoke consent at any time if you choose not to have the data fiduciary process and share your data.

What if You Don’t Let Us Collect Personal Data?

Providing your Personal Data is optional. However, if you choose not to share certain Personal Data, we may be unable to provide you with the products, services, or benefits you have requested.

Some features or functionalities of our Platform may rely on access to specific Personal Data. Refusal to provide such data may limit your ability to use certain parts of the Platform or prevent us from fulfilling your requests. However, such behaviour may make it impossible for us to assist you further via our Platform.

 

3. Legal Basis to collect your Personal Data

We will only collect, process, use or store your Personal Data if we have valid and lawful basis/reasons to do so. Your Personal Data may be processed by us based on reasons derived from the following factors:

3.1 Consent

We collect and process your Personal Data when you have given us clear and informed consent for a specific purpose.

For example, we rely on your consent when:

• You sign up to receive promotional emails, style updates, or exclusive offers

• You create a user account or input personal preferences (like body measurements or style choices)

• You agree to participate in surveys or promotional campaigns

You may withdraw your consent at any time by visiting your Privacy Settings menu or contacting our team.

3.2. Legitimate Use

We may also process your Personal Data without your explicit consent when it is necessary for legitimate uses as defined in the applicable laws, and where such processing does not override your fundamental rights and freedoms.

This includes, but is not limited to:

• Fulfilling contractual obligations such as processing orders and providing customer support

• Detecting and preventing fraud or security threats

• Improving our products, website, and user experience

• Complying with applicable laws and responding to lawful requests

We always ensure that such use is reasonable, fair, and in line with your expectations as a user of our Platform.


4. How long do we store your Personal Data

We keep your Personal Data only for as long as it's needed to provide you with our services and for legitimate business purposes, including:

• Processing your orders and returns

• Maintaining and improving the performance of our website and services

• Understanding shopping trends to offer better products and experiences

• Complying with legal and regulatory requirements

• Preventing fraud and resolving any disputes

Here are some of the categories of our retention periods, and the criteria we use to determine them. Kindly note that this is not an exhaustive list.

Purpose: To manage user registration

Data Retention Period: We will process your data for the time during which you remain a registered user on our platform

Purpose: Performance and execution of purchases/ service contract

Data Retention Period: We will process your data for the time necessary to manage the purchase of the products or services that you buy, including potential returns, complaints or claims related to the purchase of the product or service in question.

Purpose: Customer support

Data Retention Period: We will process your data for the time necessary to meet your request or application.

Purpose: Marketing

Data Retention Period: We will process your data until you unsubscribe or cancel your subscription to the marketing/promotional mailers/messages.

Likewise, we will show you personalized ads until you change your mobile or browser settings such that permission to do so is revoked.

 

We will process your data for the time strictly necessary to achieve the purpose in question, we will subsequently keep them duly stored and protected for the time during which liability may arise for their processing, in compliance with legislation in force from time to time. At the end of the retention period, your Personal Data will be deleted completely or anonymised.


5. Sharing and Disclosure of your Personal Data

We prioritize the security and privacy of your Personal Data. We do not sell or otherwise disclose your Personal Data to third-parties except in cases where your Personal Data is required to accomplish the intended processing purposes mentioned under this Privacy Notice. We share your Personal Data, on a need-to-know basis, with the following categories of recipients and for the respective purposes, as an essential part of being able to provide our services to you, including but not limited to:

1. With our affiliated and group of companies including subsidiaries, brand partners, and companies which we may acquire.

2. With our Service Providers/Partners who help us operate, promote and improve our services. They provide us services such as data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing, legal support, transportation/logistics, warehouse and security operations.

Examples of service providers we may share your data with:

○ Service provider operating the contact centre to provide Customer Assistance to users of our website/application.

○ Transportation/Logistics companies delivering products purchased on our website/application to our customers,

○ Companies providing technical support and infrastructure for our website/application.

Where our service providers need to have access to your Personal Data, we will (1) select providers who respect your privacy and comply with data protection laws at any time ; (2) only give them access to the data they need to perform their services; (3) ensure that they will only use the data for the purposes agreed in our contract with them; (4) ask them to delete or return any Personal Data when we stop using their services.

3. With Law enforcement and other authorities, or other parties to litigation to: (i) comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements; (ii) assist in the prevention or detection of crime; (iii) protect the safety of any person; and (iv) establish, exercise or defend legal claims.

4. In the context of merger and acquisition, with our Affiliates or new owner(s), we may transfer your data if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.

 

 

6. Cross-Border Data Transfers

Because of the Global nature of our business, we have operations inside and outside of India and we use suppliers and fulfilment centers across the world. Please be informed that your Personal Data, may be transferred to and stored on servers or databases located outside of India. Furthermore, we may disclose your Personal Data to our affiliates, associated entities, call centres, re-sellers, wholesale partners, and service providers located outside of India for the purposes specified in this Privacy Notice.

Whenever we transfer your data in this manner, we will take steps that are reasonably necessary to ensure adequate safeguards are in place to protect your Personal Data and to ensure it is treated securely and in accordance with this Privacy Notice. When relevant, we rely on approved data transfer mechanisms (such as standard contractual clauses) to ensure your data is subject to adequate safeguards in the recipient country.


7. Security Measures we take to protect your Personal Data

We have implemented and maintain appropriate administrative, technical and organizational measures to ensure a level of security that is fitting to protect any Personal Data provided to us. We understand that as effective as our security measures are, no security system is impenetrable. Despite that, we maintain security measures in accordance with applicable data protection laws and industry practices to protect the Personal Data you provide to us against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data during transmission, storage, and processing.

We have put various safeguards in place including tokenization, encryption such as Transport Layer Security (TLS) and AES, access, and retention policies to guard against unauthorised access and unnecessary retention of Personal Data in our systems. In addition, Personal Data stored in our computer systems are secured by physical security measures.

Further, you are responsible for maintaining the confidentiality and security of your login id and password. Please do not share your Urbanic login, password, and OTP details with anybody. It shall be your responsibility to intimate us in case of any actual or suspected compromise to your Personal Data.


8. Links to Third-Party Websites, Services and Social Media Platforms

Our Platform may include links to other websites or applications. Such websites or applications are governed by their respective privacy policies/notices, which are beyond our control. Once you leave our servers (you can tell where you are by checking the URL in the location bar on your browser or on the m-site you are redirected to), use of any Personal Data that you provide on these websites or applications is governed by the privacy policy of the operator of the application/website you are visiting. We do not accept any responsibility or liability for usage of your Personal Data by these third parties or their policies.

Similarly, many of our customers use and enjoy the tools provided by social media, and we include links to several social media platforms on our Platform. If you use our Platform to interact with these social media tools, your experience on those social media sites will be subject to the privacy and other policies of those platforms. The extent to which your data is made public will be determined by the privacy settings you have selected on those sites. You are advised to adjust your privacy settings on those sites accordingly.


9. Your Rights in relation to your Personal Data

We want you to be in control of your Personal Data and you have certain rights with regard to the Personal Data which we process as described below.

Your Right: Right to correction and erasure of Personal Data.

Explanation: Request that we correct, complete or update your Personal Data where it is inaccurate, incomplete or needs amendment.

Request that we erase certain of your Personal Data:

• That we no longer need for the purpose it was collected for.

• That we process based on the lawful basis of consent, and you withdraw your consent.

There are situations where we will be unable to delete your data, for example when:

• It’s still necessary to process the data for the purpose we collected it for.

• We have a legal obligation to keep the data.

• We need the data to establish, exercise or defend legal claims. For example, if there’s an unresolved issue relating to your account.

Your Right: Right of Grievance Redressal

Explanation: If you ever have a concern or complaint about how we’re handling your Personal Data, or if you feel your privacy rights have not been respected, you have the right to raise a grievance with us.

We are committed to resolving your concern within a reasonable time period. Before taking your issue to the Data Protection Board, we request that you first give us a chance to address and resolve it.

Your Right: Right to Nominate

Explanation: You have the right to nominate another individual—such as a parent, lawful guardian, or any trusted person—to act on your behalf in case you are unable to manage your account due to incapacity or death.

This nominated person will be able to exercise your data rights, including accessing, correcting, or deleting your Personal Data, in accordance with applicable laws and our privacy practices.

Your Right: Right to withdraw consent

Explanation: You have the right to withdraw your consent for the processing of your Personal Data at any time. If you no longer wish for us to use your data for a specific purpose (such as receiving communications, or receiving personalised ads and personalised recommendations, or any other consent-based processing), you can notify us and we will stop processing your data for that purpose.

10. Children’s Privacy

We are deeply committed to safeguarding the privacy of minors and ensuring compliance with applicable laws pertaining to the collection and processing of the Personal Data of children. We do not intentionally or knowingly collect any Personal Data related to children or individuals under the age of 18, nor do we encourage their usage of the website and application.

Our Platform is only available to people who can form legally binding contracts under the Indian Contract Act of 1872. Persons who are deemed 'incompetent to contract' under the Indian Contract Act of 1872, including minors, are ineligible to use our Platform. A minor (any person under the age of 18) should not use, access, or transact on our Platform. If a minor wishes to use, transact, or provide Personal Data on our Platform, such Personal Data must be provided by parents or lawful guardians.


11. For Persons with Disabilities

We are committed to ensuring that all users, including persons with disabilities, can access and use our Platform with dignity, equality, and independence.

If you are a person with a disability and require assistance in understanding or managing your account, consents, personal data or exercising privacy rights, you may nominate a parent or lawful guardian to act on your behalf.

To nominate a representative, please provide us with appropriate documentation confirming their legal authority. To verify this, we may request supporting documents such as a Government ID, court order, official certificate, or nomination proof. We treat all such data with the highest level of confidentiality and in accordance with applicable data protection laws.

12. Cookies and other tracking technologies

We use cookies, web beacons and other similar tracking technologies to track the products you viewed and purchased online, the areas or pages you viewed on our Platform, and other data related to your browser and browsing behaviour. Browsing data is used by us to improve the design and content of our platform, to suggest content and products that we believe may be of interest to you, and to assist us in learning things like which pages and interfaces are most appealing to our visitors, what promotions visitors prefer to see, and to assess the success of our advertising campaigns.

Note: Cookies are small text files that a website asks the user’s browser to save on the user’s system/device, when a user visits the website, in order to remember the user’s device upon revisiting the website or during the session. Cookies set up by the domain in.urbanic.com, are called first-party cookies and cookies set by other domain(s) than the website(s) you are visiting are termed as third-party cookies. Third-party cookies are generally used for marketing and advertising purposes.


13. Interpretation

This Notice is written in English (UK) and supersedes any other translated version of the document or the meaning it may imply.


14. Changes to this Privacy Notice

We may make changes to this Privacy Notice from time to time. The date this Privacy Notice was last updated appears at the top of the document. You can check our Platform on a regular basis to see if there have been any recent changes to this Privacy Notice.

If you are not satisfied with our response or if you consider your privacy rights have been breached, you may file a complaint with the Data Protection Board of India.
